Justices of Court of Appeal job at Judicial Service Commission
Judicial Service Commission
Justices of the Court of Appeal have several key responsibilities, which generally revolve around reviewing decisions made by lower courts.
Appellate Review:
Review Lower Court Decisions: Justices review cases from lower courts (typically trial courts) to determine if there were any legal errors that could have affected the outcome. This involves reading briefs, reviewing records, and hearing oral arguments.
Interpretation of Law: They interpret and apply laws and legal precedents to the cases they review, ensuring consistency and correctness in the application of the law.
Opinion Writing:
Drafting Opinions: Justices write detailed opinions that explain the legal reasoning behind their decisions. These opinions can set important precedents for future cases.
Concurring and Dissenting Opinions: Justices may also write concurring opinions (agreeing with the majority but for different reasons) or dissenting opinions (disagreeing with the majority).
Panel Deliberation:
Panel Discussions: Appellate cases are usually heard by a panel of justices rather than a single judge. They collaborate and deliberate to reach a majority decision.
Decision-Making: They vote on the outcome of cases after deliberations, and the majority vote determines the court’s ruling.
Legal Research and Analysis:
Conducting Research: Justices perform extensive legal research to ensure their decisions are well-founded.
Analyzing Precedents: They analyze previous court decisions to ensure consistency and adherence to established legal principles.
Administrative Duties:
Court Management: Senior justices may have administrative responsibilities, such as managing court staff, overseeing court procedures, and ensuring the efficient operation of the court.
Continuing Education: They often participate in continuing legal education to stay updated on new laws and legal trends.
Public Service and Outreach:
Legal Education: Justices may engage in public speaking, teaching, or writing to educate the public and legal community about the law.
Community Engagement: They may participate in community outreach programs to enhance the public’s understanding of the judicial system.
